Terms of Service

1. Who we are

The website at trendshopy.us (the "Site") is operated by Hostvento LLC, a limited liability company formed in the State of Wyoming, United States, trading as Trendshopy. In these Terms, "we", "us" and "our" mean Hostvento LLC trading as Trendshopy, and "you" means the person using the Site or placing an order.

Support is available Monday to Saturday, 9:00 to 18:00 EST.

2. Accepting these Terms

These Terms of Service govern your use of the Site and every order you place through it. By browsing the Site, subscribing to our emails or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms should be read together with our Privacy Policy, Shipping Policy, Refund and Return Policy and Payments page, which form part of this agreement. Where one of those pages gives more detail on a topic, that detail applies.

3. Who can order

You must be at least 18 years old, or the age of majority where you live if higher, to place an order. By ordering you confirm that the name, address, contact and payment details you give us are accurate and that you are authorised to use the payment method.

If you order on behalf of a business, you confirm you are authorised to accept these Terms for that business.

4. Products and descriptions

We try hard to describe and photograph every product accurately. Colours can look slightly different depending on your screen, and measurements and weights are approximate. Product images may show styling items that are not included; the product description sets out what is in the box.

All products are subject to availability. If something you ordered turns out to be unavailable, we will tell you promptly and either offer an alternative or refund any amount paid for that item in full.

Beauty and personal-care products are for external use only. Read the label, follow any instructions, and patch test before first use.

5. Prices

All prices are shown and charged in Indian rupees (INR). Prices exclude shipping, taxes and import duties unless stated otherwise. Shipping for your destination and any applicable sales tax are confirmed before you pay.

We may change prices at any time, but changes do not affect orders already accepted. If a product is listed at an obviously incorrect price because of a clear error, we may cancel the order and refund any amount paid, even after confirmation, and we will tell you if we do.

6. How the contract is formed

Placing an order on the Site is an offer to buy. When you place an order we email you an order confirmation with your order number. That email confirms we have received your order; it is not yet acceptance.

We then email you a secure Stripe payment link for the final total, including shipping and any taxes. A binding contract is formed when your payment is completed and we accept the order. We may decline or cancel an order before dispatch, for example where an item is unavailable, a pricing error has occurred, a delivery address cannot be served, or a payment is flagged as potentially fraudulent. If we cancel an order you have paid for, you receive a full refund.

7. Payment

Payments are processed by Stripe. We accept Visa, Mastercard, American Express, Discover, Apple Pay and Google Pay. Card details are entered on Stripe's secure pages and are never stored on our systems. Your bank may ask you to approve the payment with 3-D Secure.

If your card is in another currency, your bank converts the amount at its own rate and may charge a foreign transaction fee. Those fees are set by your bank and are not received by us. See our Payments page for details.

8. Changing or cancelling an order

You can change or cancel an order free of charge within 12 hours of placing it, or at any time before you complete payment, provided it has not been dispatched. Email us at support@trendshopy.us with your order number. Once an order has been dispatched it cannot be cancelled, but you can return it under our Refund and Return Policy.

9. Shipping, title and risk

We ship to over 120 countries. Orders are dispatched within 1 to 3 business days of payment and every parcel is tracked. Delivery estimates are set out in our Shipping Policy. They are estimates, not guaranteed delivery dates.

Risk of loss or damage passes to you when the order is delivered to the address you gave us. Title (ownership) passes to you when we receive full payment. Please check your address carefully; we are not responsible for orders delivered to an incorrect address you supplied.

10. Customs, duties and import taxes

International orders may be charged import duties, taxes and customs fees by the destination country. These are the responsibility of the recipient, are not included in our prices, and are not collected by us. If a parcel is refused because charges were not paid, we can refund the goods once the parcel is returned to us, less the original and return shipping costs.

11. Returns and refunds

You may request a return within 30 days of delivery, subject to the conditions in our Refund and Return Policy. Items that arrive damaged, defective or incorrect are replaced or refunded at no cost to you. Nothing in these Terms limits any rights you have under consumer protection laws that apply to you.

12. Intellectual property

The Site and its content, including text, graphics, logos, layout and software, are owned by or licensed to us and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, scrape, republish or exploit any part of the Site for commercial purposes without our written permission. Third-party product names and trademarks belong to their respective owners.

13. Acceptable use

When using the Site you agree not to:

• break any law or infringe anyone's rights;
• place fraudulent or speculative orders, or use a payment method you are not authorised to use;
• attempt to gain unauthorised access to the Site, its servers or any connected system;
• introduce viruses, malware or any harmful code;
• use bots, scrapers or automated tools to collect data from the Site, or overload it;
• submit content that is unlawful, abusive, defamatory or misleading.

We may suspend access or cancel orders where we reasonably believe these rules have been broken.

14. Third-party services and links

The Site uses third-party services, including Stripe for payments and shipping carriers for delivery. Their own terms apply to your use of their services. The Site may also link to other websites. We do not control and are not responsible for third-party websites or their content.

15. Product warranty and disclaimers

Products are supplied with any manufacturer warranty stated on the product page or packaging. Where you are a consumer, you also have the benefit of any rights implied by law, which these Terms do not exclude.

Except as stated above and to the extent permitted by law, the Site and its content are provided "as is" and "as available". We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

16. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential losses, or for loss of profit, business, data or opportunity.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.

17. Indemnity

You agree to indemnify us against reasonable claims, losses and costs (including legal fees) that arise from your breach of these Terms or your misuse of the Site, to the extent permitted by law.

18. Events outside our control

We are not responsible for delay or failure to perform caused by events outside our reasonable control, including carrier disruption, customs delays, severe weather, natural disasters, pandemics, strikes, power or internet failures, war or government action. If such an event affects your order, we will tell you and, where it continues, you may cancel and receive a refund for anything not delivered.

19. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute will be handled by the state or federal courts located in Wyoming, unless the consumer protection laws of your country of residence give you the right to bring proceedings in your local courts, in which case you keep that right.

Before starting any formal dispute, please contact us at support@trendshopy.us. Most problems are resolved quickly once we know about them. If you see a charge you do not recognise, contact us before raising a dispute with your bank.

20. General

If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. These Terms, together with the policies they refer to, are the entire agreement between you and us about your use of the Site and your orders. You may not transfer your rights under these Terms without our consent.

21. Changes to these Terms

We may update these Terms from time to time. The version published on the Site when you place an order applies to that order. The "Last updated" date at the top of this page shows when the Terms last changed.
